Dosner Organic Farms welcomes you to our Terms and Conditions. Please read these Terms and Conditions carefully, before placing your order. 

Dosner Organic Farms reserves the right to change or modify these Terms and Conditions, at any time and in our sole discretion. If we may make changes to these Terms and Conditions, we will provide notice of such changes, by updating the “Last Updated Date” at the end of these Terms and Conditions. We encourage you to review the Terms and Conditions, frequently to ensure that you understand the Terms and Conditions that apply when you access or use our Site or place an order, receive or use the Products we offer. If you do not agree with our Terms and Conditions, you may not access or use our Site or place an order and you should not receive or use our Products. 

ONLINE STORE TERMS

By agreeing to these Terms and Conditions, you are representing that you are at least 18 years old and you are responsible for paying for the products you are ordering, through our Website.

By creating an account at our Website, you are consenting to receive electronic communications from Dosner Organic Farms (via email or text). These communications may include notices about your account, we may also send you promotional communications, including, but not limited to, newsletters, special offers, surveys and other information regarding the products you are ordering from us. You are welcome to let us know should you prefer not to receive any of these promotional Emails.

PAYMENTS

By you providing a credit or debit card information, you are accepting that you are authorized to use the designated payment method and that you are authorizing us (or our third-party payment processor) to charge your payment method for the total amount of the order of our products you had placed.  These charges will also include freight charges and any applicable taxes. If the payment method cannot be verified or is invalid or not acceptable, your order will not be process and ship, until is completely pay for.

PRICING AND AVAILABILITY

All of our products display the price for each unit. Our prices may change through the different season of the year based on the availability of fresh products. The availably gets determined sometimes by the weather conditions of the different regions were we source our fresh products from.

We carry some fresh products all year around. These products come from different regions or countries based on the season here in California. Few products are only available in the season these products grow here in California and these products are not allowed the in USA from other countries.

Remember when you place an order and you provide us with a method of payment, you are agreeing to pay the total amount of the order. This total amount, will included shipping charges, and any applicable taxes.

PRODUCT DESCRIPTIONS

Dosner Organic Farms, try to be as accurate as possible with all of our product descriptions.  However, we do not warrant that all product descriptions, and photos, are error-free. Remember most of the fresh organic products offered by Dosner Organic Farms are organic and not perfect made by nature. We are specifically working with organic produce that may look a little different or have some variations from the pictures taken for our Website in a different season of the year. Due to the weather conditions, the fresh products may vary in color and shape from the pictures showing on our Website.  

SHIPPING INFORMATION

Delivery Packaging:

All fresh products are packed either in a plastic FedEx envelope or cardboard box. We include frozen gel packs to keep the integrity of fresh quality.

Delivery Date:

FedEx delivers Monday to Saturday, except on the holidays, and after the holidays, be aware that the freight charge is higher for Saturday delivery. At the time of check out, you will choose the FedEx service that you would like to use and the date you would like to receive your order. You, the customer, are completely responsible for the freight charges. Dosner Organic Farms does not issue credit on freight charges, unless you receive a poor-quality product and you follow the appropriate steps to report the problem as soon you receive your order (within the first 24/hrs. of receiving the products). 

We are not responsible for fresh products that spoil if they are not received and handled properly on the date requested.

Orders over $200.00 signature requested: Shipments over $ 200.00 total amount will require a signature on delivery.

DELIVERIES AND PICK UPS

As soon your order arrives, you are completely responsible for inspecting all Products for any damage. You should properly store all items you received, including the items that need refrigeration. If you do not receive your delivery, if you are missing items, or if you are not completely satisfied with your items, please contact us within 24 hours of receiving your order and we will work with you to take care any issues with the order you received.

There may be some instances, as a result of extreme weather or other unforeseen circumstances, that your delivery cannot be made on the date you requested. In those cases, we will make our best effort to deliver your order as close as possible to the requested delivery date. 

For any customers who would like to a pick-up their order at our warehouse, please send the information clearly of the date and time you will like to pick up your order. For any orders not picked up during the time window requested by the person placing the order, Dosner Organic Farms may donate the order, already paid, to the Los Angeles Food Bank. No refund will be honored on orders not picked up, as the pick-up option was chosen by you, our customer.

REFUNDS AND REPLACEMENTS

If you are dissatisfied with any of our products, please contact us within 24 hours of your delivery. If you would like to request a credit, or replacement of your order you need to follow these steps:

  1. Take a good picture of the product showing the problem you are claiming is wrong with the product.
  2. Put the product in refrigeration, if it is a fresh product.
  3. Contact us immediately or within the first 24/hrs. of receiving your delivery at (323)720-9225 or E-mail us at info@dosnerorganic.com.
  4. Based on the information provided by you, and depending on the circumstances, we will provide you with a full or partial credit or refund of the purchase price of your order.

CANCELLATION POLICY

Any items placed in your cart that have been paid will have a 2/hrs. maximum from the time you paid the order to the time we will begin scheduling delivery. Should you like to cancel your order it must be done within the 2/hrs. allowed time. After this 2/hrs. cancellation on orders will not be accepted. Your order will be processed and shipped to be delivered the day you requested.

All the contents including in this site, text, pictures any other graphics or code is copyrighted as a collective work under Title 17 of United States Code most updated version. All of the information in this Website and on-line store are property of Dosner, LLC/dba Dosner Organic Farms/dba Dosner Specialty Produce and are protected by the by the copyrights law Title 17 of the United States Code.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Dosner, LLC/dba Dosner Organic Farms, Dosner Specialty Produce and our affiliates partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party.

DISCLAIMERS

The person placing and receiving the order is solely responsible for the proper and safe use of all the product purchased at our online store. Dosner Organic Farms is not responsible in any way for food allergies or how the fresh products are used in the preparation of any food for human or animals’ consumption.

LIMITATION OF LIABILITY

To the fullest permitted by the law, in no way shall Dosner, LLC/dba Dosner Organic Farms or Dosner Specialty Produce will be liable for any indirect, incidental or consequential exemplary or punitive damages of any kind. Including loss of revenue, income or profits, loss of data, or damages for business interruption. Cause by access to our website or our E-mail communications. Even if the party has been notified of the possibility of such damage and regardless of whether such damage was foreseeable.

SEVERABILITY

In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable. Such provision shall be enforceable to the fullest extent permitted by the law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions. This determination shall not affect the validity and inforceability of any other remaining provisions.

TOTAL AGREEMENT

Should we choose not to exercise or enforce any right or provision of these Terms and Conditions, this action shall not constitute a waiver of such right or provision.

These Terms and Conditions, or any other policies or operating rules posted on our Website and online store constitutes the entire agreement and understanding between you and us. And makes you responsible for your use of the Products you are purchasing from us. The most current terms, conditions and policies superseding any prior agreements, communications and proposals. Whether were made oral or written, between you and us.

GOVERNING LAW

These Terms and Conditions and any separate agreements whereby we provide you with a service of fulfilling a purchased order of the product offered in our Website and online store shall be governed by and construed in accordance with the laws of Commerce, California, USA.
